These Terms of Service (“Terms”) govern all business relationships between VIVA Scandinavia Canada (“VIVA”) and customers (“Customer”) via VIVA’s online shop at shopviva.com. Products are offered for end consumers only in household quantities. “Consumer” refers to natural persons purchasing for personal use, not business purposes. Delivery is available only within VIVA’s designated regions. These Terms prevail over any conflicting terms from the Customer unless explicitly agreed in writing by VIVA.
Product listings in the online shop are informational and do not constitute a legally binding offer, except when PayPal is selected. Orders become binding when the Customer clicks Buy Now (PayPal) or Send (other payment methods). VIVA reserves the right to reject unavailable orders and will refund any payments promptly. Customers must be 18 years or older. Purchase agreements are provided in the language offered in the online shop.
Customers may cancel their purchase within 14 days without providing a reason. The period starts from the date the Customer or a third party accepts the last shipment. To cancel, send a clear notification via mail, fax, or email to:

Customers are responsible for any loss in value caused by improper handling beyond what is necessary to assess the goods.
Delivery is made to the address provided by the Customer within VIVA’s delivery regions. Partial shipments may be made if necessary. Delivery dates are approximate; delays caused by force majeure or other factors beyond VIVA’s control will be notified promptly. If delivery cannot be completed, VIVA may rescind the purchase agreement and refund all payments.
Prices are valid at the time of order and include statutory sales tax. Shipping and additional service fees are specified at checkout and borne by the Customer.
Payments are due upon delivery unless advance payment is selected. Accepted methods: Credit Card (Visa/MasterCard), IDEAL, Bank Transfer, PayPal. Credit card amounts are blocked at order placement and charged at shipment. Customers may offset claims only if legally recognized, undisputed, or acknowledged by VIVA.
Goods remain the property of VIVA until all payments under the purchase agreement are received.
Customers may request replacement or repair for defective goods according to applicable law. Warranty claims expire two years after delivery.
VIVA is liable only for: death, bodily harm, or health damage caused intentionally or by gross negligence; non-compliance with written guarantees; product liability under Canadian law; breach of essential contractual obligations due to minor negligence, limited to foreseeable damage. Other damages are excluded. Claims under minor negligence lapse after 12 months. Liability exclusions extend to VIVA’s staff and agents.

These Terms are governed by Belgian law. If any provision is invalid, the remaining provisions remain effective. For merchants, disputes shall be brought to VIVA’s registered office in Overpelt, unless VIVA chooses a general legal venue.
